These Terms of Use ("Terms") are a legal agreement governing your use of the Pawfolio Pet Passport iOS application, pawfolio-site.vercel.app, Pawfolio support, and related features (collectively, the "Service"). "Pawfolio," "we," "us," and "our" refer to Pawfolio Pet Passport.
By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Pawfolio. If you have not reached the age of legal majority where you live, a parent or legal guardian must authorize your use. You may use the Service only where permitted by law.
2. Limited License
Subject to these Terms, Pawfolio grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Service on Apple-branded devices you own or control, as permitted by Apple's Usage Rules, solely for lawful personal pet-care organization.
The Service is licensed, not sold. Pawfolio and its licensors retain all rights not expressly granted in these Terms.
3. Your Content
"Your Content" means pet profiles, records, photographs, videos, contact details, care instructions, incident information, documents, and other material you add to Pawfolio.
You retain your rights in Your Content. You give Pawfolio only the limited permission needed for the app to store, process, display, synchronize, export, and share Your Content as you direct. You are responsible for:
- the accuracy and completeness of Your Content;
- having the rights and permissions needed to add or share it;
- reviewing medication, contact, insurance, and veterinary information before relying on or sharing it; and
- protecting your device, Apple Account, backups, exports, and shared links.
4. Veterinary and Emergency Use
Pawfolio does not verify Your Content and is not a medical record system operated by a veterinarian. Never delay contacting a veterinarian, emergency clinic, poison-control service, or other qualified professional because of information displayed—or not displayed—in Pawfolio.
Do not rely on Pawfolio, a notification, QR code, shared file, or iCloud Sync as the only source of information in an urgent situation. You are responsible for confirming that information is current, readable, received, and suitable for the situation.
5. Sharing, QR Codes, Incident Reports, and Sitter Mode
Pawfolio can create QR links, pet-passport PDFs, incident reports, calendar care passes, and data exports. You control when these items are created and shared. Review every preview and included-information option before sharing.
Anyone with an emergency-passport QR image or complete link can view the information encoded in it. QR links are not password-protected and cannot be remotely revoked. Updating or deleting information in Pawfolio does not update a QR code or file already shared.
Sitter Mode creates a calendar file a recipient can open without installing Pawfolio. Calendar alerts depend on the recipient's calendar settings. Completion, edits, or deletion of a recipient's calendar event do not sync back to Pawfolio.
Once shared, recipients and third-party apps may retain, copy, or forward information. You are responsible for selecting recipients and obtaining permission before sharing another person's contact details or other protected information.
6. Pawfolio Premium
Pawfolio includes free functionality and offers an auto-renewable monthly subscription called Pawfolio Premium. Premium features may include higher usage limits, multiple pet profiles, recurring care and reminders, Sitter Mode, sharing and export tools, and optional iCloud Sync. The app identifies which actions require Premium.
Before purchase, the Pawfolio screen and Apple's purchase sheet show the current localized price, subscription period, included benefits, and any offer Apple has made available to your account. Payment is charged to your Apple Account when you confirm the purchase. Unless Apple's purchase sheet expressly displays a trial or introductory offer, billing begins immediately.
Pawfolio Premium renews automatically each month unless canceled at least 24 hours before the end of the current billing period. Apple charges your Apple Account and manages payment, renewal, cancellation, and refund eligibility. You can manage or cancel the subscription in Apple Account subscription settings.
Deleting the app or using Delete All Pawfolio Data does not cancel Pawfolio Premium. If Premium ends, Premium actions may become unavailable or revert to free limits. Where practical, Pawfolio will preserve access to data you already created, but you may need to renew Premium or reduce content before adding or changing certain items. Restore Purchases can refresh an eligible Apple entitlement.
7. iCloud, Notifications, and Apple Device Services
Pawfolio features may depend on Apple services and device capabilities, including iCloud, CloudKit, StoreKit, local notifications, Face ID, Photos, camera, microphone, Files, calendar files, and the iOS share sheet.
Their availability depends on your device, operating system, Apple Account, permissions, connectivity, available storage, recipient software, and Apple's services. Synchronization, reminders, sharing, authentication, and purchases may be delayed, interrupted, or unavailable. Pawfolio does not guarantee that a notification will be delivered at a particular time.
8. Acceptable Use
You agree not to:
- use the Service for unlawful, harmful, deceptive, fraudulent, or abusive purposes;
- add or share content you do not have the right or permission to use;
- access or attempt to access another person's data or account without authorization;
- interfere with, damage, overload, scrape, resell, or misuse the Service or website;
- bypass usage limits, subscription checks, access controls, or security features;
- copy, modify, reverse engineer, disassemble, or derive source code except where applicable law expressly permits it; or
- represent that Pawfolio provides veterinary diagnosis, treatment, monitoring, or emergency response.
9. Pawfolio Intellectual Property
Pawfolio's software, design, interface, branding, text, graphics, and other original material—excluding Your Content—are owned by Pawfolio or its licensors and protected by intellectual-property laws. No right to use Pawfolio's trademarks, name, or branding is granted except as necessary to use the Service.
If you voluntarily submit feedback, you permit us to use it without restriction or compensation, provided we do not publicly identify you without permission.
10. Third-Party Services
The Service may rely on or link to Apple and other third-party services. Pawfolio does not control their content, policies, security, availability, or performance. Your use of those services is governed by their own terms and privacy policies.
11. Privacy
Our Privacy Policy describes what information stays on your device, how optional iCloud Sync and sharing work, what Pawfolio receives directly, and the controls available to you.
12. Updates, Changes, and Availability
We may release updates and may add, change, limit, or discontinue features to improve Pawfolio, address security or legal requirements, or reflect changes to Apple services. We will follow applicable law and App Store requirements when changes materially affect a paid subscription.
We do not promise that every feature will always be available, uninterrupted, compatible, secure, or error-free, or that data loss can never occur. Maintain independent copies of information you cannot afford to lose.
13. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." Pawfolio disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and quiet enjoyment.
Pawfolio does not warrant that user-entered information is accurate; that reminders, synchronization, or sharing will occur on time; that shared information will be received or acted upon; or that the Service will meet the needs of a particular pet, caregiver, or veterinary professional.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
14. Limitation of Liability
To the fullest extent permitted by law, Pawfolio and its owners, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, use, or opportunity arising from or related to the Service.
To the fullest extent permitted by law, total liability for all claims arising from or related to the Service will not exceed the greater of (a) the amount you paid for Pawfolio during the twelve months before the event giving rise to the claim or (b) USD $100. These limits do not apply where liability cannot legally be limited.
15. Suspension and Termination
You may stop using Pawfolio at any time. We may suspend or terminate access to Service components we control if you materially violate these Terms, misuse the Service, or create a legal or security risk. Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive.
Ending use of Pawfolio does not automatically cancel a subscription. Apple subscription cancellation is a separate action.
16. Apple App Store Terms
These Terms supplement the Apple Standard Licensed Application End User License Agreement ("Apple Standard EULA"). If these Terms conflict with terms Apple requires, the required Apple terms control.
Pawfolio—not Apple—is responsible for the Service and its content, maintenance, support, and any product claims, subject to the Apple Standard EULA. Apple has no obligation to provide maintenance or support for Pawfolio. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the terms relating to your license and use of Pawfolio.
17. Governing Law and Disputes
These Terms are governed by the laws of Pennsylvania, United States, without regard to conflict-of-law rules. Courts with jurisdiction in Pennsylvania may hear disputes arising from these Terms or the Service. If consumer-protection law where you live requires another governing law, venue, or remedy, that mandatory law applies.
Before filing a claim, you and Pawfolio agree to make a reasonable effort to resolve the issue informally by contacting the other party. This paragraph does not prevent either party from seeking urgent relief or using a small-claims process where eligible.
18. Changes to These Terms
We may update these Terms as the Service or law changes. The revised Terms will be posted here with a new "last updated" date. We will provide additional notice when required. If you continue using the Service after revised Terms become effective, you agree to the revised Terms, except where additional consent is required by law.
19. General
If part of these Terms is found unenforceable, the remaining terms remain in effect and the affected term will be enforced to the greatest extent permitted. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the Service, subject to applicable law.
